Introduction, Operator and Scope
This Refund & Cancellation Policy (“Policy”) is published by SKYSCRAPERS INFO LIMITED, a company organised under the laws of Hong Kong SAR (“Operator”, “we”, “us”), in respect of the website https://skyscrapersinfo.ltd and any associated services it may offer.
The Operator may from time to time offer, in the course of its business, paid services including but not limited to: skyscraper-related media and editorial projects, architectural research, custom information reports, photography and video commissions, drone and aerial imaging, visual asset design, brand and visual-identity work for construction and built-environment clients, sponsored editorial features, advertising campaign services, data, mapping and information products, and other bespoke professional services falling within the Operator’s expertise in tall buildings and the global built environment.
This Policy applies to refund and cancellation matters arising from those paid services where a relevant contractual or legal arrangement exists. It does not, and is not intended to, govern every interaction with the Website. Browsing the Website, reading published editorial content, subscribing to newsletters or sending an enquiry or request for proposal do not, by themselves, create a paid engagement and do not entitle any visitor to a refund.
The Policy operates alongside the Operator’s other documents, in particular the Service Terms & Conditions at /service-terms and the Advertising Policy at /advertising-policy. Where the wording of those documents is not directly available during drafting, cross-document consistency is identified below as pending review.
This Policy does not override any specifically accepted agreement between the Operator and a Client, nor does it override any right that cannot lawfully be excluded under the law that applies to a particular transaction.
Document status: This document is a draft, not yet in force and not yet approved by the Operator. It is published for preview only.
Definitions
Capitalised terms used in this Policy have the meanings set out below. Where a term is also defined in the Service Terms & Conditions, the meaning in the Service Terms prevails for the purposes of any incorporated agreement.
- Operator
- SKYSCRAPERS INFO LIMITED, Hong Kong SAR, being the legal entity that publishes this Policy and that contracts for the Services.
- Client
- Any natural or legal person who engages the Operator for Services, whether as a Business Client or as a Consumer Client.
- Business Client
- A Client acting for purposes related to that person’s trade, business, craft or profession, including developers, architectural firms, contractors, asset owners, agencies, publishers and similar entities.
- Consumer Client
- A Client acting wholly or mainly outside that person’s trade, business, craft or profession and who is recognised as a consumer under the law that applies to the transaction.
- Services
- The research, media, photography, video, design, advertising, information, data and bespoke professional services that the Operator may supply under an accepted Order or SOW.
- Deliverables
- The tangible or digital outputs produced under an accepted SOW, including but not limited to images, video files, written reports, datasets, designs, layouts, drawings and information products.
- Order
- A validly accepted order, quotation acceptance or engagement request that, together with any reference terms, describes the Services to be supplied. A mere engagement request, enquiry or expression of interest does not, by itself, constitute an accepted Order or automatically create a service contract. Whether an Order has been validly accepted depends on applicable law and on what the parties have actually agreed.
- Statement of Work (SOW)
- A written project-specific document describing scope, deliverables, fees, milestones, dependencies, acceptance criteria and other commercial terms, signed or otherwise validly accepted by both parties.
- Advance Payment
- A payment made by the Client in advance of the corresponding Services or Deliverable having been completed and accepted, where the accepted agreement so provides. Advance Payments are distinct from payments made for work that has already been performed and accepted.
- Deposit
- A type of Advance Payment used, where the contract so provides, to reserve capacity, secure specific dates, fund preparatory work or underwrite agreed cancellation commitments. The classification “Deposit” describes the contractual purpose of a payment; the classification “Milestone Payment” describes its link to an agreed project stage. These classifications are not mutually exclusive and may overlap where the accepted agreement so provides.
- Milestone Payment
- A payment linked to an agreed project stage, deliverable or acceptance event under the accepted SOW. Depending on what the accepted agreement provides, a Milestone Payment may be payable before or after the corresponding work is performed. The classification “Milestone Payment” describes the link of a payment to an agreed project stage and may overlap with a Deposit or with an Advance Payment where the accepted agreement so provides.
- Cancellation
- Termination, in whole or in part, of an accepted engagement by the Client or by the Operator, prior to full performance and acceptance.
- Refund
- The return of money, in whole or in part, that the Operator is permitted or required to make to the Client under the applicable agreement and law.
- Credit
- A non-cash value applied against future Services that the Operator may, at its discretion and where contractually appropriate, offer in lieu of a cash Refund.
- Rescheduling
- The postponement of a delivery date, production date, milestone or acceptance event to a later date, rather than a Cancellation.
- Approved Expenses
- Third-party and out-of-pocket costs that have been validly authorised in the SOW or in a subsequent written approval, in accordance with Section 12.
- Third-Party Costs
- Costs payable by the Operator to a third party in performing the Services, including for licences, permits, contractors, equipment, travel, accommodation and venues.
- Nonconformity
- A failure of a Deliverable or Service to correspond in a material respect to the specifications or requirements validly agreed in the SOW.
General Refund Principles
Refund eligibility is determined by the agreement that has been validly accepted, the work that has actually been performed, the costs that have been validly incurred, any lawful cancellation terms and any mandatory rights that apply to the Client.
A voluntary commercial Refund granted by the Operator as a matter of goodwill is distinct from a Refund that the Operator is legally required to make. Nothing in this Policy converts a discretionary commercial gesture into a legal entitlement, nor does it expand any statutory right beyond what the law provides.
A Client does not have an unconditional right to cancel a bespoke, commissioned or customised project at any time without financial consequence. Equally, the Operator cannot refuse to consider appropriate remedies where it has materially failed to provide an agreed Service.
Where a Refund is calculated, the starting figure is the amount actually received from the Client in respect of the relevant transaction. From that figure, the Operator deducts only amounts that are lawfully and contractually attributable to that transaction, less any amounts already refunded, so that no cost or amount is deducted twice.
A Refund begins with the amount actually received from the Client for the relevant transaction, less lawful deductions properly attributable to that transaction and less any amounts already refunded. No cost or amount may be deducted twice. This is a conceptual calculation, not a universal contractual Refund formula; mandatory legal remedies and any agreed transaction-specific methodology take precedence.
This Policy is to be read alongside the Operator’s Service Terms and, where relevant, the Advertising Policy. In the event of a conflict between this Policy and a specific term of an accepted SOW or Master Service Agreement, the specific agreement prevails for that transaction, except where a term is unlawful or unenforceable.
Contract Formation and Applicable Documents
No paid engagement arises merely because a visitor browses the Website, downloads a brochure or sends an enquiry. A preliminary enquiry, an unsigned quotation, an estimate of fees or a discussion of scope does not, in itself, establish a paid project.
This Policy applies to contractual refund and cancellation arrangements only where it has been validly incorporated into the agreement between the Operator and the Client, or where it otherwise applies as a matter of law. Incorporation may occur by reference in a signed proposal, an accepted quotation, an Order, an SOW, a Master Service Agreement or an Insertion Order, as appropriate.
The order of precedence that the Operator intends to apply, subject to mandatory law, is:
- Accepted amendments and Change Orders relating to a specific transaction;
- The accepted project-specific SOW or Order, together with any incorporated quotation or proposal;
- The Master Service Agreement, if any;
- The public Service Terms at
/service-termsand this Refund & Cancellation Policy, to the extent each is validly incorporated.
Where the engagement involves advertising or sponsored content, the accepted Advertising Agreement or Insertion Order governs the campaign-specific terms. The Advertising Policy at /advertising-policy supplements those documents where validly incorporated, but does not automatically form a separate binding contractual tier above the accepted engagement documents.
The Operator does not intend this Policy to rewrite, retrospectively or otherwise, contracts that have already been validly concluded. Amendments to existing agreements require appropriate agreement between the parties.
The legal consequences of any term being unlawful, void or unenforceable depend on applicable law and on the structure of the agreement as a whole. Whether a term is severed, whether remaining provisions continue in force, and whether an invalid provision is rewritten or substituted are governed by the rules that apply to the transaction. These consequences are not assumed to operate automatically, and in particular an invalid exemption clause is not to be treated as if it had been automatically rewritten into an enforceable provision.
Deposits and Advance Payments
A Deposit is distinct from payment for work that has already been performed. Where the contract so provides, a Deposit may be used to reserve production or research capacity, secure specific dates (such as for location-dependent filming), fund agreed preparatory work or underwrite an agreed cancellation commitment.
The refundability of a Deposit depends on the terms that have been validly agreed, the extent to which the Operator has incurred costs or committed resources in reliance on the engagement, and applicable law. The Operator does not represent that every Deposit is automatically forfeited on Cancellation, nor that every Deposit is automatically refundable. Each case turns on its facts and contract.
The Operator does not fix, by this Policy, a universal advance-payment percentage. Any such percentage, if used, must be set out in the accepted SOW or proposal and must be reasonable in context.
Where a Deposit secures a genuine reservation of capacity or a genuine commitment accepted by the Client, the Operator may retain an amount proportionate to the commitment undertaken and the costs actually incurred, provided the basis for retention is disclosed and lawful. Where the basis for retention is challenged, the burden lies on the Operator to justify the amount retained.
Deposits, Advance Payments, Milestone Payments and payments for work already performed and accepted serve different functions. Their functions differ but may overlap depending on the timing of the payment and on what the accepted agreement actually provides; a single payment may, for example, be both an Advance Payment and a Deposit, or both a Milestone Payment and a Deposit. The Operator does not treat every payment as a Deposit, and does not treat every pre-billed sum as automatically refundable or automatically non-refundable by category alone.
Pending review: the detailed treatment of Deposits and Milestone Payments in the Service Terms Section 10 has not been verified word-for-word during the drafting of this Policy.
Cancellation Before Project Commencement
This Section addresses a Cancellation made after a project has been accepted but before substantial production work has begun.
Where work has been properly authorised and performed in preparation for the project, the Operator may retain or recover payment for that preparatory work. Time spent preparing an unsolicited quotation, an unrequested proposal or other internal work for which the Client has not validly agreed to pay is not automatically chargeable to the Client.
Where a Cancellation occurs shortly before significant expenses are due to be incurred — for example, in respect of filming dates, travel bookings, drone permits or venue reservations — the Operator may deduct from any refundable balance the amount of any non-cancellable third-party commitment that has been validly approved in accordance with Section 12.
Any remaining balance, after permitted deductions, shall be calculated fairly and returned where the Operator is not entitled to retain it under the contract or by law. The Operator does not claim an unconditional right to retain money for which there is no valid contractual or legal basis.
If the Client cancels before commencement and seeks to recover sums already paid, the Client should normally identify the order, the date of payment and any communications that bear on whether a paid engagement had been validly formed.
Cancellation During Performance
Where a Cancellation occurs after substantial performance has begun, the Operator may, where lawful, retain or recover payment corresponding to Services already performed and Approved Expenses properly incurred.
The applicable SOW may establish either milestone-based or time-based calculations for the allocation of fees between completed work, work in progress and work not yet delivered. The Operator does not impose, by this Policy, a fixed Cancellation fee or percentage; any such figure, if used, must be set out in the accepted agreement.
A Client may not obtain Deliverables corresponding to work that has been completed and then recover the price of that work merely by describing the transaction as cancelled, where no legal ground supports recovery. At the same time, the Client retains whatever remedies are available under the contract and applicable law for defective or materially nonconforming performance.
Where Deliverables already produced remain in the Operator’s possession and the Operator is otherwise entitled to payment for them, the Operator may, at its discretion, elect to withhold delivery of those Deliverables until payment for the corresponding work is received, subject to the Operator’s obligations in respect of confidential material and applicable law.
Where the Operator is in material breach, the Client’s right to cancel and to recover sums paid in respect of unperformed Services is preserved, subject to Section 13.
Cancellation After Delivery or Acceptance
Proper acceptance of compliant work is distinct from delivery of work that does not conform to the agreed specifications. Once a compliant Deliverable has been completed and accepted, an ordinary change of preference does not, by itself, justify a Refund.
The Operator does not assert that downloading, opening, viewing or receiving a digital file automatically and in every case extinguishes every right that a Client may have. Where mandatory consumer rights apply, including any right of withdrawal that has not been lawfully and validly excluded or waived, those rights are preserved.
Any deemed-acceptance mechanism included in a project agreement must be valid, reasonable, properly incorporated and must allow the Client a genuine opportunity to inspect the Deliverable. The Operator will not rely on a deemed-acceptance clause to defeat a substantiated complaint of Nonconformity.
Where a Client seeks to reverse a transaction after acceptance, the Operator may, at its discretion, offer a Credit against future Services. A Credit is a voluntary commercial arrangement. It is not a cash Refund and does not confer any monetary entitlement against the Operator beyond the value of the future Services to which it is applied. A Credit must not be used to replace a Refund that the Operator is legally required to make in money, unless the Client has validly and lawfully agreed to accept the Credit in lieu of cash and applicable law permits that substitution.
Revisions, Changes of Mind and Additional Work
Not every request to revisit a Deliverable is a ground for Refund. The Operator distinguishes between the following categories:
- Correction of material Nonconformity. Where the Deliverable does not conform to the accepted specifications for reasons attributable to the Operator, the Operator will, at its cost, take reasonable steps to bring the Deliverable into conformity.
- Included revisions. Where the accepted SOW specifies a number of included revisions or rounds of feedback, those revisions form part of the agreed price and are not chargeable separately, subject to the scope of the SOW.
- Out-of-scope Client requests. Requests that materially extend scope, add Deliverables or change the agreed creative direction are outside the original engagement and may require a Change Order.
- Changes of artistic or commercial preference. A change of preference after work has been produced in accordance with the agreed brief is not, by itself, a Nonconformity.
- New Deliverables or new project requirements. Additional Deliverables or new requirements constitute new work and are not refundable in respect of work already performed.
The Operator’s failure to meet agreed specifications is not to be characterised as a change of mind. Equally, a Refund request does not automatically entitle a Client to unlimited unpaid revisions. The number, scope and cost of revisions are governed by the accepted SOW.
Client Delays, Rescheduling and Abandoned Projects
Late approvals, missing reference material, unavailable subjects or locations, delayed access to premises and other Client-side delays affect scheduling and may affect cost. Where the SOW permits, the Operator will accommodate reasonable Rescheduling requests without penalty.
Where Rescheduling is accepted, the Operator may reschedule production capacity in good faith. Any Rescheduling charge must be agreed in advance, supported by identifiable cost and proportionate. Rescheduling charges are not penalties for late decision-making disguised as cost recovery.
Where a Client repeatedly misses agreed deadlines, fails to provide necessary input, or remains inactive for a sustained period, the Operator may, where the accepted agreement provides an appropriate contractual or other valid legal basis, after written notice and a reasonable opportunity to respond, treat the project as abandoned or terminated. The Operator does not claim an automatic unilateral right to terminate every inactive project, and will not rely on inactivity alone to extinguish the Client’s contractual position. Any retention of sums in such a case must be supported by the contract, by work actually performed and by validly incurred Approved Expenses, and the consequences of abandonment must be proportionate and consistent with applicable law.
Where abandonment by the Client follows significant work having been performed, the Operator is entitled to retain an amount proportionate to that work, with any remainder refunded in accordance with Sections 06 and 07.
Photography, Filming, Travel and Location-Dependent Services
Location-dependent services, including architectural photography, drone filming, aerial imaging and on-site research, involve costs and commitments that cannot always be unwound without financial loss.
Special conditions apply to the following categories, which are typically addressed in detail in the SOW:
- Reserved photography, filming and production dates;
- Travel, accommodation, transport and per-diem commitments;
- Drone operations, airspace permissions and any consents required from property or building owners;
- Access to private property, restricted areas or sites controlled by third parties;
- Weather, visibility, lighting and ambient conditions;
- Venue, building-management or event-organiser restrictions;
- Engagement of production contractors, equipment hire, lifts, cranes and rigging;
- Last-minute postponements by either party.
The allocation of risk and cost between Operator-caused cancellations, Client-caused cancellations and unavoidable events (such as extreme weather rendering safe operation impossible) must be specified in the accepted SOW. The Operator does not claim that ordinary adverse weather always permits it to retain all fees; nor does it claim that any delay or postponement automatically extinguishes the Client’s right to a proportionate remedy.
The Operator does not represent that it holds any specific licence, permit, insurance or authorisation that has not been confirmed by the Operator’s actual records at the time of the engagement.
Approved Third-Party Expenses
Approved Expenses include, without limitation, stock imagery, footage and music licences, software licences, permits, venue reservations, equipment hire, travel and accommodation, contractor fees and other sums payable to third parties in performing the Services.
Such expenses may be recovered by the Operator or deducted from any sum otherwise refundable only where:
- The expense is provided for in the SOW or otherwise validly approved in writing;
- The expense has actually been incurred and is supported by reasonable evidence on request;
- The expense is proportionate and reasonably necessary for the engagement; and
- The recovery or deduction is not precluded by applicable law.
The Operator does not claim that every third-party invoice is automatically non-refundable, nor does it impose unlimited expenses without prior authorisation. Where appropriate, the Operator will provide a reasonable breakdown of Approved Expenses to support any deduction from a Refund.
Where the Operator intends to incur an expense that materially exceeds the budget set out in the SOW, the Operator will seek the Client’s further written approval before incurring it, unless the SOW provides otherwise.
Failure, Material Nonconformity and Operator-Caused Cancellation
Where the Operator cannot perform an agreed Service, materially fails to meet accepted specifications, misses a firm deadline in circumstances constituting breach, cancels a Service without applicable contractual justification, or provides materially defective Deliverables, the Client is entitled to an appropriate remedy.
Possible remedies include, depending on the facts, the agreement and applicable law:
- Correction of the Nonconformity at the Operator’s cost;
- Repeat performance of the Service;
- A proportionate reduction in price;
- A Refund of sums paid in respect of unperformed or nonconforming Services; and
- Any other remedy required by applicable law.
The exact remedy depends on the nature of the failure, the terms of the accepted agreement and the rights that the Client enjoys under applicable law. The Operator will not attempt to exclude liability that cannot be excluded as a matter of law.
Where the Operator cancels without contractual justification, or where the Operator determines that it cannot lawfully provide a promised Service, the Operator will refund Advance Payments made in respect of Services that will not be performed. Any deduction from that Refund must be independently justified under the accepted agreement and applicable law, taking account of the nature and consequences of the Operator’s breach. The Operator will not automatically transfer the costs of its own failure to the Client, and the Client retains all remedies required by applicable law, including any right to a full or partial Refund, damages or other relief.
Where applicable law permits recovery of payment for genuinely separable Services that were properly performed before the Operator’s failure, that entitlement is preserved, provided the relevant work is independent of the breach and the Client has received the corresponding value.
Pending review: the precise carve-outs and remedies set out in the Service Terms Sections 08, 09, 13, 14 and 21 have not been verified word-for-word during the drafting of this Policy.
Digital Products, Reports, Data and Information Licences
The Operator may, in due course, offer digital reports, custom research, datasets, maps, visual assets and other downloadable or licence-based information products. The Operator does not represent that any such product is currently on sale or that any digital checkout currently exists.
Refund and cancellation treatment depends on the nature of the product and on applicable law. The Operator distinguishes the following categories:
- An ordinary downloadable product supplied on standard terms;
- A custom-commissioned research project produced under a bespoke SOW;
- A licensed dataset or visual-asset licence;
- A time-limited subscription or access pass;
- A Deliverable produced under a bespoke engagement that happens to be delivered in digital form.
Digital content is not to be designated non-refundable merely because it is intangible. Where the law applicable to a transaction permits a Client to withdraw within a defined period after express consent and acknowledgement, the Operator will observe the conditions required by that law rather than treating delivery or download alone as sufficient to extinguish withdrawal rights.
Subscription-specific terms, including renewal, suspension and pro-rated refunds, will be set out in a separate Subscription Terms document at /subscription-terms before any subscription service is launched. Until that document is in force, the Operator does not accept subscription orders on the terms described in this Section.
Advertising and Sponsored Campaign Refunds
This Section applies to advertising and sponsored campaign services only to the extent that such services are offered. The Operator does not represent that advertising bookings are currently accepted.
Campaign-specific calculations — including reserved inventory, creative preparation, agreed media spend, delivery metrics, make-goods and Approved Expenses — are governed by the accepted Advertising Agreement, Insertion Order or campaign-specific SOW. This Policy does not displace those documents.
The Operator does not guarantee traffic, clicks, impressions, leads, sales, conversions or any other campaign outcome unless an express guarantee has been accepted in writing. The Operator distinguishes between an actual failure to deliver a contractual obligation and a campaign that simply underperforms commercially.
Where the Operator materially fails to deliver an agreed advertising service, the Client’s remedies include correction, repeat performance, proportionate reduction in fees, a Refund in respect of undelivered services and any remedy required by applicable law.
The Operator’s liability for media spend depends on the structure of the engagement and on applicable law. Where the Operator acts as a disclosed intermediary or agent purchasing third-party advertising on the Client’s behalf, the Client’s remedies are shaped by the terms granted to the Operator by the upstream supplier. Where the Operator contracts as principal and undertakes responsibility for delivery, the Operator bears the corresponding delivery risk. Where, under a valid agreement, the Client has separately assumed specified supplier cancellation or non-refund risks, that allocation is respected, subject to applicable law. Where the Operator itself fails to perform its own contractual obligations, recovery from an upstream supplier does not, by itself, determine the Client’s rights against the Operator.
Campaign-specific allocation of risks, Refunds and make-goods is set out in the accepted Advertising Agreement or Insertion Order, subject to mandatory law. The Operator preserves the distinction between disappointing advertising results and an actual failure to deliver a contractual commitment.
The provisions of this Section are intended to be consistent with the Advertising Policy at /advertising-policy. Pending review: the precise wording of the Advertising Policy has not been verified word-for-word during the drafting of this Policy.
Refund Requests and Review Procedure
Refund and Cancellation requests should be submitted through the communication channels listed on the Contact page at /contact. No new contact form, email address, client portal or refund hotline is created by this Policy.
To enable the Operator to review a request, the Client may be asked to provide:
- The relevant Order, invoice or transaction reference;
- The name of the agreement or project and the parties involved;
- Evidence of the Client’s identity or authority to make the request;
- A clear description of the reason for the request, including the section of the Policy or agreement relied on;
- Copies of any supporting documents, communications or evidence on which the Client relies;
- A preferred contact method and up-to-date contact details.
The Operator may reasonably request clarification, supporting material and information necessary to investigate disputed work or charges. The Operator will not impose a procedure so burdensome that it operates to defeat legally protected cancellation or refund rights.
The Operator does not commit, by this Policy, to a fixed response deadline. Where a transaction-specific or legally required timetable applies, that timetable will be observed. Until such a timetable is established, requests will be reviewed without undue delay.
Refund Amount and Processing
Where a Refund is approved, the amount is determined by reference to the accepted fees, work performed, Approved Expenses, lawful deductions and any mandatory rights that apply.
Approved Refunds will ordinarily be processed through the original payment channel where permitted and practical, subject to the rules of the relevant payment provider, applicable law and the Operator’s security and fraud-prevention checks.
The Operator does not represent that every bank, card scheme, payment processor or currency is supported. Where a Client requests payment to a different destination, the Operator may require identity verification, fraud-prevention and payment-authorisation checks before processing.
The Operator does not commit, by this Policy, to a universal Refund-processing deadline. Where a legally required deadline or an expressly accepted transaction-specific timetable applies, that deadline or timetable will be observed. Refunds will not be reduced by undisclosed processing fees, arbitrary administrative charges or expenses that cannot lawfully be deducted.
Where currency conversion is necessary, the Refund currency, the permitted exchange-rate methodology, the application of payment-provider rules and the allocation of conversion fees are determined by the applicable agreement, the actual payment arrangements between the Operator and the Client, and mandatory law. The Operator does not commit, by this Policy, to support any specific currency, bank or payment channel. No undisclosed fee and no fee that cannot lawfully be deducted may be applied to a Refund.
Billing Disputes, Chargebacks and Fraud Prevention
A genuine billing or quality dispute is distinct from a duplicate payment, an unauthorised transaction or suspected fraud. The Operator reserves the right to provide relevant transaction evidence and to respond to bank or payment-provider investigations in good faith.
The Operator does not purport to waive any statutory chargeback right or payment-dispute right that a Client enjoys under the rules of the relevant card scheme, payment provider or applicable law. Nor does the Operator categorically penalise every Client who initiates a chargeback. Each matter is considered on its facts.
The Operator will not make unsupported allegations of fraud. Where the Operator has reasonable grounds to suspect that a transaction is fraudulent, unauthorised or duplicative, the Operator may suspend the relevant Refund or delivery pending verification and may notify the relevant authorities or payment providers.
The Operator may undertake reasonable identity, fraud and duplicate-payment verification before processing a Refund. Any temporary restriction resulting from such checks must be justified, proportionate and legally permissible. These checks do not create an unlimited right to delay Refunds, to suspend statutory remedies or to override mandatory payment deadlines.
Where a Client has already received a Refund and a subsequent chargeback, credit-card claim or duplicate recovery is initiated in respect of the same sum, the Operator may treat the matter as double recovery and take proportionate steps to protect its position, including the recovery of any sums paid in error, subject to applicable law. The Operator preserves its ability to contest fraudulent or duplicative recovery through lawful procedures.
International Clients, Mandatory Rights and Governing Law
This Policy is proposed to be governed by, and construed in accordance with, the laws of the Hong Kong Special Administrative Region of the People’s Republic of China, subject to the mandatory rules applicable to a particular Client or transaction.
Business Clients and Consumer Clients may enjoy materially different rights. The Operator will not apply a single uniform international Refund rule across both categories. Where a Consumer Client enjoys a non-excludable mandatory right under the law that applies to the transaction — for example under EU or UK distance-selling or digital-content rules, or under equivalent regimes elsewhere — that right is preserved.
The Operator does not assert that the worldwide accessibility of the Website automatically subjects every transaction to every foreign consumer-protection regime, nor that the choice of Hong Kong law automatically defeats mandatory consumer rights that apply by operation of law. Each transaction is assessed according to its own connecting factors.
This Policy does not impose blanket waivers of EU, UK or other mandatory consumer protections, nor does it impose mandatory consumer arbitration or unrealistic restrictions on access to competent regulators where such access is granted by applicable law.
Pending review: the precise governing-law clause and dispute-resolution provisions set out in the Service Terms Section 22 have not been verified word-for-word during the drafting of this Policy.
Amendments, Related Policies and Contact
The Operator may update this Policy from time to time. Any update will apply prospectively as legally appropriate. Updates will not retroactively rewrite contracts that have already been validly concluded unless the parties agree otherwise.
The current published version of this Policy is identifiable by its draft status and by its publication URL. Material changes will be reflected by a revised draft, version note or effective date where the document is brought into force.
This Policy should be read alongside the Operator’s other published documents. The Operator must verify the final destination of each URL listed below before this Policy is brought into force. The Advertising Policy at /advertising-policy has been confirmed accessible but remains in Draft pending final approval and an effective date; it is not presented as approved or contractually effective. The Subscription Terms has not yet been published. No other live status of any linked page has been independently confirmed during drafting.
Where a transaction-specific agreement is in place, that agreement governs the individual project, subject to applicable law and to the mandatory provisions of the documents incorporated into it. The Operator retains legally recognised communication and notice methods, as further described on the Contact page.
The Operator’s company registration number, registered office address, designated contact email and any future refund hotline have not been included in this draft because they have not yet been confirmed. They will be added once they have been verified and the document is brought into force.
